The first domino has fallen!

On Tuesday, May 26, 2020, the Appellate Commissioner issued its ruling on the attorney’s fees related to the defeated appeal brought by Doc’s Dream, LLC., et al.   The award was for sixty thousand, five hundred twenty and twenty-five cents ($60,520.25). This represents 100% of the amount requested by Dolores Press, Inc., et al. The Appellate Commissioner explained that the reason for this ruling was due to Doc’s Dream counselors, Carlos Leyva and Linda McAleer, failure to rebut the reasonableness of the amount requested. Doc’s Dream argued that Dolores Press was not entitled to attorney’s fees but did not oppose the amount. As stated previously, the appellate court ruled that Dolores Press is entitled to its reasonable attorney's fees. This left the Appellate Commissioner the burden of finding the reasonableness of the fees. Is There Trouble in Doc’s Dream Land?

In a surprise move, Doc’s Dream, LLC., Patrick Robinson, Bobbi Jones, Truth Seekers, Inc. have requested the court to dismiss their attorneys of record. The court has denied their request. It is unknown to this writer if the Robinson defendants will be filing a motion to remove their legal counsel. This is not much of a surprise as the loses have been piling up for Robinson, et al. The latest loss being the discretionary award of attorney fees for Dolores Press, et al. What is left to the imagination is whether this was an act of anger and frustration or a plan that he gave abundant thought. In legal proceedings corporate entities must be represented by legal counsel. However, in the court filing, Robinson, et al. informed the court they will proceed pro se. Without a substitution of attorney, the judge will not allow this withdrawal. In fact, the day following Robinsons request, the judge issued his order denying the request. The move is chaos. Will Patrick Robinson’s Nightmare Become a Real-Life Catastrophe for The Digital Business Law Group?

Carlos Leyva and Linda McAleer have been Robinson’s attorneys through a declaratory action seeking to have a judge declare the copyrights to the works of the late Gene Scott abandoned. They are currently representing Robinson in his defense for the copyright infringement cases brought by Dolores Press and Melissa Scott. These attorneys advised Robinson to proceed with the declaratory action despite there being a last will and testament, corporate board minutes, audio/video recordings and copyright notices fixed on every recording by Dr. Gene Scott; each measure taken to apparently protect the copyrights of the contested works. Upon the advice from these two attorneys, Robinson moved forward with a weak case. Robinson’s evidence failed in his Motion for Summary Judgment. Furthermore, it seems that when Robinson’s legal team discovered that there were fatal flaws in their case, they attempted to shift their legal theory from complete abandonment to a Naked License theory.
