Patrick Robinson Gives an Update in His FUMS #41
In his FUMS #41 video Patrick
Robinson gives another victory update. But is this an accurate report?
It is correct that the court did
rule on the motion for consolidation. This was a motion brought by Dolores/Scott
and opposed by Robinson. Therefore, I cannot comprehend Robinson’s update. In
the video, Robinson says a few things that are inaccurate: 1) The cases are
being consolidated under his first case. 2) Robinson acts like this consolidation
is a victory for his group. 3) The undisputed fact that “It is undisputed that
Dr. Gene Scott permitted downloads and encouraged the sharing and distribution
of his teachings.”
The first point is false. The
cases are being assigned under Dolores Press’ first filed case, as evidenced by
the court’s order Granting Dolores Press’ Motion for Consolidation, document 164
filed on 08/13/2019 page 4 of 4, wherein the Judge ordered the cases be
consolidated under: Dolores Press Inc. v Patrick Robinson, et al. 2:15-cv-02562-R-PLA.
Further evidence that the case is not of Robinson’s making is that the Judge
ordered the clerk of the court to close Robinson’s case: Doc’s Dream LLC v
Dolores Press Inc. I’d also remind Robinson, in his order Denying Robinson’s Motion
for More Definite Statement, the judge stated that his case (Doc’s Dream v
Dolores Press) is closed, except for Dolores Press’ counterclaim. The courts
order is clear, the cases are consolidated under Dolores Press’ case, not Robinson’s.
The next point to consider is
Robinson claiming a victory with this consolidation. This is mere histrionics.
There is no victory for Robinson here, unless he is considering it a victory to
waste his follower’s money on frivolous motions. Remember that Robinson’s
attorneys opposed this consolidation. Why does Robinson consider it a victory for
the judge to grant a motion that he and his attorneys opposed? The answer is,
it is not a victory. This is an outright loss for Robinson, and he is trying to
save face. The facts surrounding the situation beg the question: Does Robinson
know that he is losing all his motions? Robinson’s Motion for Summary Judgment.
Robinson’s Motion to Consolidate Under Doc’s Dream v Dolores Press. Robinson’s Motion
for More Definite Statement. Dolores Press’ Motion to Consolidate, opposed by
Robinson – Granted. These are not victories for Robinson, they are defeats.
Finally, Robinson reads from
Judge Real’s order denying his motion for summary judgment and granting Dolores
Press’. In it he reads, what Judge Real called, an undisputed fact that “It is
undisputed that Dr. Gene Scott permitted downloads and encouraged the sharing
and distribution of his teachings.” Well, I hate to be the bearer of bad news
for the Robinson click, but this is not an undisputed fact. Real got this wrong
and it will be demonstrated in Robinson’s trial when he tries to claim this “undisputed
fact”. The reality is Dolores Press did dispute this claim, in Defendant’s
Opposition to Plaintiff’s Motion for Summary Judgment, page 4 lines 15-26, in
part:
“Nowhere in
Defendants’ Motion for Summary Judgment is there an admission that, by having a
website that permitted downloading, Dr. Scott intended to permit more than a
copy for personal use, and was authorizing the free reproduction and further
distribution of Dr. Scott’s copyrighted works.”
The popular “undisputed fact” being
propagated by Robinson is demonstrably false. Sorry, but this isn’t a victory
and reading from an order handing you your defeat isn’t proof of any victories.
I’m convinced that Robinson is
being lied to by his attorneys or they are working together to deceive their
group. There isn’t a rational reason why there would be so much blatant and
demonstrable dishonesty, unless it is pure ignorance. But that would mean it is
the lawyers who are the deceivers. Either way, this is not a victory for
Robinson, neither is there any support for their “undisputed fact”.
What are the undisputed facts in
this case? Dolores Press and Melissa Scott have been victorious in all these
cases, from the prevailing motion for summary judgment, Appellate remand of
dismissed cases for trial, to the recent motion for consolidation. As one of
Robinson’s fanatics has repeated to this writer, “Dolores/Scott won nothing”,
but the reality is Robinson has won nothing. He has delayed the inevitable for
5 years, costing himself and his followers hundreds of thousands of dollars,
but now he is being sued in the district court. Yes, he may use limited
abandonment/naked license as a defense. But is this going to work? An
undisputed fact is, any license granted to the defendants by Dr. Scott died
when he did. This is not a question, there is plenty of precedent supporting
this fact. Another undisputed fact is Melissa Scott owns all the copyrights to
Dr. Scott’s works. She has the exclusive right to do with them as she pleases.
If she wanted to destroy them, she could. If she wanted to put them all on
display for public viewing, she could. If she wants to publish them into books,
she can and is. If she wants to remaster them and rebroadcast them, she can and
is.
The undisputed facts are in
support of Dolores Press and Melissa Scott. Robinson has achieved nothing but
debt from over 5 years of litigation. Robinson is no closer to victory than he
is to walking on the moon. He should not be claiming victory. If he would
accept advice, stop now. Stop giving these false updates. Stop pretending to be
victorious. That way you won’t look as foolish when you lose to Dolores/Scott.
